Terms of Service
Waiver is a fantasy football app operated by RIGHT AT HOME ENT INC. Its home on the web is waiver.games. The same service was released earlier on the web under the name Hard Knocks Fantasy. That name is retired, but it still appears on the address league invitation emails are sent from. Waiver and Hard Knocks Fantasy are one service run by one operator, and these terms cover both.
Waiver, Hard Knocks Fantasy and RIGHT AT HOME ENT INC are not affiliated with, endorsed by or sponsored by the National Football League (NFL), the NFL Players Association, any NFL team, the NCAA, or any college, university or athletic conference. Player names, team names and statistics are factual data from third-party sources, used for identification and descriptive purposes only. All marks belong to their respective owners. See section 10.
These terms are the agreement between you and RIGHT AT HOME ENT INC ("we", "us") for using Waiver. By creating an account or using the app or the website, you agree to them. If you do not agree, please do not use Waiver.
1. What Waiver is — and is not
Waiver is a season-long fantasy football app you play with friends. You create a league, invite people, draft a team of NFL or college football players, set your lineup each week, and play head-to-head against your leaguemates for the season. That is the whole product.
There are no entry fees. There are no prize pools. There is no wagering, betting or gambling of any kind. There are no real-money contests and no cash, prizes or anything of value to be won.
Waiver does not collect, hold, transfer or pay out league dues, buy-ins, pots, winnings or any other player-to-player money. It has no wallet, no balance and no payout mechanism, and we have no plans to add one. Winning your league gets you exactly one thing: bragging rights.
The only payment that ever happens in Waiver is an optional purchase you make from us for the AI GM assistant, described in section 6. That is a software feature, not a stake and not an entry fee.
If you and your friends arrange money between yourselves outside the app, that is entirely your own business and your own responsibility. It has nothing to do with Waiver, we take no part in it, and we do not facilitate, track or endorse it.
2. Your account
- You must be at least 13 years old to use Waiver. Where local law sets a higher minimum age, that age applies.
- One account per person. Keep your sign-in details to yourself — you are responsible for what happens on your account.
- Give us an email address you actually read. It is how we reach you about your account.
- Tell us straight away at info@waiver.games if you think someone else has access to your account.
- You can delete your account at any time, yourself, from inside Waiver. You do not need to ask us. See section 12 for where the control is and what deleting does to your leagues.
3. Acceptable use
Do not:
- Harass anyone. This includes league names, team names, bot names, chat messages and invitations. No slurs, no threats, no sexual content involving minors, no targeted abuse, no impersonation of a real person or organisation.
- Scrape the service. No bulk or automated extraction of players, data, pages or content from the app, the website or our APIs.
- Automate drafts against other users. Do not use scripts, bots, macros or any automated tool to make picks, claim players or act in a league that has other real people in it. The app's own autodraft is fine — that is a feature we built. A third-party bot picking for you against your friends is not.
- Break in, or try to — no probing, scanning, reverse engineering, circumventing sign-in, rate limits or paid feature locks.
- Overload the service, or use the AI GM in a way designed to run up our costs.
- Resell, sublicense or white-label Waiver.
- Use Waiver to run a real-money contest, pool, book or wagering operation of any kind.
- Break any law that applies to you.
We can remove content and suspend or close accounts that break these rules. For anything involving a genuine threat to someone's safety, we will act immediately and without notice.
4. League content and ownership
You own what you write. Your league name, your team name, your messages and anything else you create in Waiver stay yours. We do not claim ownership of them.
To actually run a fantasy league, we need permission to show what you write to the people you are playing with. So you grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, display and transmit your content for the purpose of operating Waiver — which in practice means showing it to your leaguemates, putting your picks on the draft board, and keeping your league running. That licence exists only to run the service. It ends when you delete the content or your account, except for copies that remain in ordinary backups for a short time, and except for league history that other managers still need, as described in our Privacy Policy.
We do not use your content for advertising, marketing or training AI models.
Waiver itself — the app, the website, the code, the design, the name and the logo — belongs to RIGHT AT HOME ENT INC. Using Waiver does not give you any rights to it beyond permission to use the service under these terms.
5. Commissioners and league disputes
Every league has a commissioner, who can change scoring, waiver and trade settings and manage the league. That is a power we give to a person in your league, not to us. We do not referee league disputes — vetoed trades, collusion arguments, a draft time nobody liked. Sort it out with your commissioner. We step in only where our own rules in section 3 have been broken.
6. Subscriptions and the Season Pass
Waiver is free to play. Leagues, drafts, rosters, matchups and the whole season cost nothing. The AI GM assistant is the only paid feature, and there are two ways to buy it:
You will always see the price, the billing period and the renewal terms before you confirm a purchase. If a price ever changes, the new price applies only from your next renewal, and you will be told beforehand and given the chance to cancel.
Waiver can be bought inside the iOS app through Apple, and it can also be bought on this website, where Stripe handles the payment. Which one you used decides who to ask about refunds and cancellation, so both routes are set out below.
7. Refunds
Purchases made in the iOS app
Apple handles refunds for App Store purchases, not us. We cannot issue, approve or refuse a refund for anything bought through the App Store, and we have no access to Apple's billing decisions.
Request a refund from Apple at reportaproblem.apple.com, or in the App Store app. All App Store purchases are governed by Apple's own terms and refund policy.
Purchases made on this website
Purchases made on this website are processed by Stripe and are non-refundable. You can stop paying whenever you like, and cancelling is never a fight. But money that has already been charged is not refunded.
Except where a refund is required by law. Some places give consumers a right we cannot sign away — for example the statutory right of withdrawal on digital purchases in the EU and the UK. Where the consumer law that applies to you requires a refund, you have it, and nothing on this page removes it. Email info@waiver.games from the address on your account.
Because purchases here are final, it is worth knowing exactly what you are buying first. The price, the billing period and the renewal terms are always shown before you confirm, and the AI GM — including the fact that it can be wrong — is described in section 9.
8. Cancelling
Cancelling stops future charges. Your access continues until the end of the period you have already paid for. Cancelling does not produce a refund of what you have already been charged — see section 7.
If you subscribed in the iOS app
Manage or cancel from your Apple account, not from inside Waiver: open the Settings app on your iPhone, tap your name, tap Subscriptions, choose Waiver, then tap Cancel Subscription. You can also open apps.apple.com/account/subscriptions. Do this at least 24 hours before your renewal date. Deleting the app does not cancel a subscription.
If you subscribed on this website
Email info@waiver.games from the address on your account and we will cancel it and confirm by reply.
Season Pass
Nothing to cancel. It is a one-time purchase that expires at the end of the season on its own.
9. The AI GM
The AI GM gives opinions about a game. It suggests who to start, whether a trade looks sensible, and what a player's numbers say. It is generated by a language model, it is not a person, and it can be confidently, completely wrong. Check anything that matters to you.
The AI GM is not betting advice, gambling advice, investment advice or financial advice of any kind. Do not treat it as any of those. It is entertainment attached to a fantasy football app, and every decision you make with it is yours.
We do not guarantee that any particular AI model, feature or response quality will stay the same. If the underlying provider changes or becomes unavailable, the AI GM may change or stop. See section 11.
What the AI GM sends and what it keeps is explained in our Privacy Policy.
10. Player data and affiliation
Player names, teams, schedules, projections and statistics come from third-party sources, including FantasyPros and CollegeFootballData. We do not create this data and we do not guarantee that it is accurate, complete or up to date. Statistics get corrected, feeds go down, and projections are guesses. Do not rely on anything in Waiver as an official record.
Waiver, Hard Knocks Fantasy and RIGHT AT HOME ENT INC are not affiliated with, endorsed by, sponsored by or otherwise associated with the National Football League (NFL), the NFL Players Association, any NFL team, the NCAA, any athletic conference, or any college or university. All team names, player names, league names and marks belong to their respective owners and are used for identification and descriptive purposes only. We do not use any NFL or NCAA logo, wordmark or team mark anywhere in Waiver.
11. Availability and changes
We try to keep Waiver running, but we do not promise it will always be available, uninterrupted or error-free. It depends on services we do not control, and a draft can be interrupted by an outage on somebody else's network.
We may add, change or remove features, and we may change these terms. If a change materially affects you or what you have paid for, we will give you reasonable notice in the app or by email. Continuing to use Waiver after a change takes effect means you accept the updated terms. If you do not accept them, stop using Waiver and cancel. Cancelling ends future billing and is not a refund — see section 7.
12. Ending the agreement
You can stop using Waiver at any time and delete your account yourself. On the web, open the ⚙ gear on the league screen, choose Delete account, type DELETE to confirm, then press Permanently delete my account. In the iOS app, open the Profile tab and tap Delete Account. It takes two steps on purpose, and it is permanent — there is no undo and we cannot restore it for you afterwards.
Deleting your account removes you from every league you are in, opens your team's seat back up, and cancels every invite you sent. If you run a league, it passes to the longest-serving manager left in it who can still sign in, and the league carries on without you. Picks you already made in a league that carries on stay on its draft board, no longer linked to you, because a draft board with a hole in it is not a draft board.
If you are the last manager who can still sign in, the whole league is deleted with your account — the league itself, its draft, every pick, every seat and every invite, for everyone in it. Nothing of it is kept. The confirmation screen spells this out before you confirm.
We may suspend or close your account if you break these terms, if we are required to by law, or if we discontinue the service. Except where you have seriously broken these terms, we will give you reasonable notice first. Purchases made on this website remain non-refundable under section 7, except where the law requires otherwise. Refunds for App Store purchases remain Apple's to decide, not ours.
Sections that by their nature should survive — content licence limits, disclaimers, limitation of liability, indemnity and governing law — survive the end of this agreement.
13. Disclaimer of warranties
Waiver is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that Waiver will be uninterrupted, secure or error-free, that defects will be corrected, or that any data, projection or AI GM response is accurate.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law, RIGHT AT HOME ENT INC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost goodwill, or the outcome of any fantasy league, however caused.
Our total liability to you for all claims relating to Waiver is limited to the greater of the amount you paid us in the twelve months before the claim arose, or twenty-five US dollars ($25).
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you, and your statutory consumer rights are unaffected.
15. Indemnity
You agree to indemnify and hold RIGHT AT HOME ENT INC harmless from claims, damages and reasonable legal costs arising out of content you post, your use of Waiver in breach of these terms, or your violation of the law or of anyone else's rights.
16. Governing law and disputes
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules, and the state and federal courts located in Texas are the venue for any dispute.
If you are a consumer resident in the European Union, the United Kingdom, or another place whose law gives you the right to bring proceedings in your own local courts and to the protection of your own local consumer law, nothing in this section takes that right away from you.
Before starting any formal proceedings, please email info@waiver.games. Almost everything gets resolved in an email.
17. Everything else
- These terms and the Privacy Policy are the entire agreement between us about Waiver.
- If any part of these terms is found unenforceable, the rest stays in force.
- Not enforcing a term once does not mean we give it up.
- You may not transfer your rights under these terms. We may transfer ours if Waiver is sold or reorganised, and your rights carry over.
- These terms create no rights for anyone who is not you or us, except that Apple is a third-party beneficiary of the terms that apply to App Store purchases and may enforce them.
- Neither of us is responsible for failures caused by events genuinely outside our control.
